1. Acceptance of Terms

By accessing and using MeltyMap ("the Service", "we", "us", or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of the Service, including without limitation users who are browsers, registered users, and contributors of content.

MeltyMap is a web-based platform that enables users to create Perler bead patterns from images, customize patterns, share patterns with the community, and access premium features through subscription plans.

2. User Accounts and Registration

Account Creation: To access certain features of the Service, you may be required to create an account. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security: You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Account Eligibility: You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and agree to these Terms.

Account Termination: We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

3. Subscription Services and Payments

Pro Subscription Plans

MeltyMap offers subscription plans ("Pro Plans") that provide access to premium features:

  • Pro Monthly: $9.99 per month
  • Pro Yearly: $79.99 per year (saves 33%)

Payment Processing: Payments are processed through Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms and conditions. We do not store your full payment card information on our servers.

Billing: Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the subscription fee on a recurring basis until you cancel your subscription.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to Pro features until the end of the period for which you have already paid.

⚠️ No Refund Policy

MeltyMap does not offer refunds for subscription fees. All subscription payments are final and non-refundable. This includes:

  • Monthly and yearly subscription fees
  • Partial subscription periods
  • Unused portions of your subscription
  • Subscriptions cancelled mid-billing period

By subscribing, you acknowledge and agree that you will not receive a refund for any subscription fees paid, except as may be required by applicable law in your jurisdiction.

Price Changes: We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will notify you of any price changes in advance.

Promotional Codes: From time to time, we may offer promotional codes or discounts. Promotional codes are subject to expiration dates and other terms and conditions as specified at the time of offer.

4. Copyright and Intellectual Property

You are solely responsible for ensuring that any images you upload, patterns you create, and content you share through this Service are:

  • Your own original work, or
  • Content for which you have obtained proper authorization or license, or
  • Content that is in the public domain, or
  • Content used under fair use or similar exceptions applicable in your jurisdiction

User-Generated Content: When you upload a pattern and choose to share it publicly, your content will be stored on our servers and made available to other users. You retain ownership of your original content, but by sharing it, you grant MeltyMap a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote your shared patterns on the Service.

By sharing content, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary licenses
  • Your content does not infringe upon any copyright, trademark, or other intellectual property rights
  • Your content does not violate any applicable laws or regulations
  • You will indemnify MeltyMap against any claims arising from your shared content

Prohibited Content: You agree not to upload, process, or generate patterns from:

  • Copyrighted images, artwork, logos, or trademarks without authorization
  • Images containing trademarked characters or designs
  • Any content that violates intellectual property rights
  • Content that is illegal, harmful, or infringes on the rights of others

Service Intellectual Property: The Service itself, including its design, features, functionality, and all content not provided by users, is owned by MeltyMap and protected by copyright, trademark, and other intellectual property laws.

5. User Responsibilities and Acceptable Use

You are responsible for:

  • Ensuring you have the right to use any images you upload
  • Respecting copyright and intellectual property laws
  • Not using the Service to create patterns from copyrighted material without authorization
  • Maintaining the security of your account credentials
  • Indemnifying MeltyMap against any claims arising from your use of the Service

Prohibited Activities: You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload, share, or distribute content that is harmful, offensive, defamatory, or violates the rights of others
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Share your account credentials with others or allow others to use your account
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

6. DMCA Compliance and Copyright Infringement

MeltyMap respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on our Service infringes your copyright, please see our DMCA Policy for information on how to file a takedown request.

We will respond to valid DMCA takedown notices in accordance with applicable law and may remove or disable access to content that is the subject of a valid takedown notice.

7. Service Availability and Modifications

We strive to provide a reliable service, but we do not guarantee that the Service will be available at all times or free from errors. The Service may be unavailable due to maintenance, updates, technical issues, or other reasons beyond our control.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

We reserve the right to update, change, or remove features of the Service at any time. While we strive to maintain backward compatibility, we are not obligated to maintain specific features or functionality.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MELTYMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of third parties on the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless MeltyMap, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload, share, or create through the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

If you wish to terminate your account, you may do so by contacting us or through your account settings. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MeltyMap operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription if applicable.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
